Anti-Spam Policy



One must understand “policy” for the purposes of this document as a series of measures to achieve an end.

The end intended by Ayoo Cloud is the combat against the practice of SPAM, and the measures adopted are divided into:

1) INFORMATIVE OR EDUCATIONAL: intended to clarify not only to Ayoo Cloud clients but also to the general public WHAT SPAM IS and ways to minimize accusations of SPAM practice.

2) TECHNOLOGICAL: consisting of technical instruments placed at the disposal of Ayoo Cloud clients, not only to avoid receiving SPAM (such as filters, hidden nickname; blocked email lists, origin confirmation, etc.) but also to avoid being accused of practicing SPAM (active registration confirmation).

3) REPRESSIVE: consisting of contractual provisions that authorize Ayoo Cloud to summarily take offline the sites of clients who violate the ANTI-SPAM COMMITMENT assumed at the time of contracting Ayoo Cloud services.


Anti-Spam Commitment

Ayoo Cloud, in sync with the best practices of the Internet and the most influential non-governmental organizations on the Internet, and following the appeal of its users, publicly manifests its Anti-SPAM commitment. Through it, Ayoo Cloud undertakes to hinder, by all means within its reach, the practice of SPAM and to publicize the repudiation of this practice, as well as the purpose of preventing its clients from executing it.

In return, anyone who becomes an Ayoo Cloud client accepts, fully and without restrictions, automatically, by the simple act of contracting any service provided by Ayoo Cloud, the commitment NOT TO PRACTICE SPAM IN ANY OF ITS MODALITIES OR MANIFESTATIONS.

Therefore, all Ayoo Cloud clients are obliged to follow the spam repudiation rule, holding themselves responsible for complying with the rule of not practicing SPAM under any hypothesis and under no pretext.

IF THE SENDING OF SPAM BY ANY CLIENT IS VERIFIED, THEIR “SITE” WILL BE TAKEN OFFLINE UNDER THE TERMS PROVIDED IN THE RESPECTIVE CONTRACT, WITHOUT PREJUDICE TO OTHER APPLICABLE MEASURES.

It is forbidden for Ayoo Cloud clients to receive more than 20% (twenty percent) of bounced emails, unless another limit has been expressly established in the contract signed with the client, in which case the contractually fixed limit shall prevail.

“Bounced email” is understood as any type of error that compromises the delivery of the message to its recipient.

One of the most common errors is a non-existent destination mailbox.

Thus, if the Ayoo Cloud client receives a percentage of emails higher than the 20% specified above, the presumption by Ayoo Cloud of the practice of SPAM by the client will operate.

The email for reporting SPAM that may have been practiced by an Ayoo Cloud client is abuse@Ayoocloud.com.br.

THIS IS THE ANTI-SPAM COMMITMENT OF AYOO CLOUD AND ITS CLIENTS. FULFILL IT AND ENSURE IT IS FULFILLED FOR A BETTER INTERNET.


Basic information about the characterization of the practice of spam

What is SPAM

Objectively, SPAM, for the purpose of this commitment, can be defined as the sending of emails and/or any other type of electronic message that motivates a complaint from any recipient thereof and/or any organization and/or individual with functions of combating and repressing the practice of SPAM.

SPAM is not a viable advertising medium. Although it is very tempting to use it as an advertising medium, it is forcing the entire Internet to change regulations on the use of the email system and increasing restrictions and punishments against companies that practice SPAM.

It is also important to always report SPAM, which is a negative practice for the internet, and only through reports can we combat it.


Why SPAM is a problem

The Internet is currently an extremely dynamic, complex, and information-filled environment. Email is one of the components of the Internet, and nowadays it is one of the main means of communication within it.

However, this means of communication is being increasingly degraded by the high number of emails, not only advertisements but also jokes or any other type of email sent indiscriminately, without having been requested by the recipient. That is SPAM. This degradation translates into high usage of storage space for messages, overload of servers that manage and transmit emails, overload of communication networks, etc.

Furthermore, unsolicited emails are increasingly ignored by recipients who even start to repudiate the companies that send them. Thus, even commercially, SPAM is becoming highly inadvisable.

Important: This process is not a guarantee that your site will not be accused of SPAM, but it is a way to protect yourself against it and demonstrate good faith and transparency.

ATTENTION

If there is a report of SPAM practice by any Ayoo Cloud client, if it is not a hypothesis of immediate service deactivation, Ayoo Cloud reserves the right to apply filters to contain indiscriminate sending; it will also be required that the service accused of this practice MANDATORILY use the technical resource of “Active Registration Confirmation”. Furthermore, depending solely on the subjective analysis of Ayoo Cloud, the case may be considered serious and the invalidation of the email list used by the CLIENT may be imposed, in order to ensure that the service does not continue sending potentially unwanted emails to certain addresses.


Ayoo Cloud cannot be held responsible for the measures adopted to contain the reported sendings; when filters are applied, these will not be considered as the service not being provided to the client, since the filter will be the extreme measure to contain the complaints previously reported to the CLIENT.
